Esopus, NY (December 8, 2025) – A Kingston man, identified as David Moyal, 60, was killed Monday morning after his vehicle crashed into a stopped construction truck on the northbound New York State Thruway (I-87) in the Town of Esopus.
The fatal two-car collision occurred at approximately 11:15 a.m. near milepost marker 80.7. Preliminary investigation by State Police revealed that Mr. Moyal’s 2021 Mercedes-Benz, traveling in the left lane, struck the rear of a stopped 2003 Freightliner construction vehicle. The Freightliner was positioned straddling the left shoulder and partially in the left lane as part of an operation to divert traffic for construction signage installation. The construction worker seated in the Freightliner was not injured.
Mr. Moyal was transported to Kingston Health Alliance Hospital, where he succumbed to his injuries and was pronounced deceased shortly after arrival. The investigation into the incident remains ongoing.
Navigating Wrongful Death Liability in a Construction Zone Crash in New York
The death of David Moyal, 60, triggers a Wrongful Death claim under New York law, but the involvement of a construction zone introduces immediate and complex questions of liability against multiple parties. While the deceased driver struck the rear of the stopped vehicle, a thorough investigation must focus on the negligence of the construction company and/or the state agency responsible for the work zone setup.
