Your Rights After a Single-Vehicle Crash in Chautauqua County
The Insurance Institute for Highway Safety reported that 2,899 teenagers ages 13 to 19 died in motor vehicle crashes in 2024. With one vehicle and no announced cause, investigators typically examine the road, signage, lighting, tires, brakes, weather, and whether another vehicle played a part.
- First steps: Ask the Sheriff’s Office for the crash report number and ask that the vehicle be held. Written notice to the no-fault insurer is generally due within 30 days, which is November 30, 2026.
- Who may be liable: Responsibility could rest with the driver or owner, another motorist, a parts maker, or a road authority, depending on the findings.
- If fault is shared: New York bars recovery in motor vehicle claims when a claimant’s fault equals or exceeds the combined fault of the defendants.
- Death claims: Wrongful death claims generally must be filed within two years of the death (EPTL § 5-4.1). For a death on October 31, 2026, that is October 31, 2028, and the estate may also have a survival claim.
- Injury claim: An adult’s injury claim generally has three years (CPLR § 214), which is October 31, 2029. New York can extend that period for injured minors.
- Government notice: If a village, town, or county road condition played a part, a notice of claim is due within 90 days (Gen. Mun. Law § 50-e), which is January 29, 2027.
