Legal Options After a Hit-and-Run Pedestrian Accident in Upstate NY
An unidentified driver does not necessarily leave an injured pedestrian without insurance options. A household relative’s auto policy may provide no-fault benefits, depending on coverage. This can provide a claims pathway while investigators search for the driver.
Without available auto coverage, the Motor Vehicle Accident Indemnification Corporation may provide benefits. Known as MVAIC, this organization assists eligible victims, including certain hit-and-run pedestrians. Specific eligibility, police-reporting, and claim-notice requirements apply.
Act promptly rather than waiting for police to identify the vehicle. New York generally requires written no-fault notice within 30 days, with limited exceptions. An attorney can determine which insurer or program should receive your claim.
Compensation for pain and suffering involves different legal requirements. New York generally requires a qualifying serious injury for these motor-vehicle claims. A brief news report cannot establish whether someone meets that legal standard. Medical evidence and the applicable law require individual review.
