Hannibal, NY – 21-Year-Old Motorcyclist Killed in Crash on Brackett Road

Hannibal NY motorcycle crash

Hannibal, NY (Oct.27, 2026) – Michael A. Kelly, 21, of Martville, died after a motorcycle crash on Brackett Road in the town of Hannibal, according to the New York State Police.

State Police responded to the crash at about 5:18 p.m. on October 27. The preliminary investigation indicates that Kelly was riding a 2007 Kawasaki eastbound on Brackett Road when he appeared to lose control of the motorcycle and was ejected into the westbound lane, according to police.

Kelly was then struck by a westbound 2015 GMC Sierra pickup truck operated by Shaun W. Mercer, 52, of Hannibal, State Police said. Kelly sustained fatal injuries and was pronounced dead at the scene.

The circumstances surrounding the crash remain under investigation.

This is a developing story. Details may change as the investigation continues.

Legal Considerations After a Fatal Motorcycle Crash in Hannibal, NY

In New York, a wrongful death claim for the family is brought by the personal representative of the estate. A separate survival claim covers the rider’s own losses before death (EPTL §§ 5-4.1, 11-3.2). The wrongful death deadline is two years from the date of death, which was October 27, 2026, so the deadline is October 27, 2028.

State Police say Kelly appeared to lose control, but the cause has not been established. A claim looks at the road surface and signage, the lighting, the motorcycle’s tires, brakes, and other parts, and the pickup’s speed and the driver’s reaction time. No single fact decides responsibility.

New York requires every motorcycle rider to wear a helmet (Vehicle and Traffic Law § 381). The information released does not say whether a helmet was worn. That is one fact an attorney reviews, and it does not by itself decide who was responsible.

If a town or other public agency is responsible for the condition of Brackett Road, a notice of claim is generally due within 90 days (General Municipal Law § 50-e), which puts the deadline at January 25, 2027. If fault is shared, CPLR § 1411(b), as amended in 2026, bars a motor vehicle claim when the injured person’s fault equals or exceeds the combined fault of the defendants. Otherwise, damages are reduced by that person’s share.
