Hurley, NY – 17-Year-Old Passenger Killed in Dirt Bike and Hyundai Crash on Main Street

Hurley NY dirt bike crash

Hurley, NY (Oct. 23, 2026) – A 17-year-old passenger died after a dirt bike and a Hyundai collided at the intersection of Schoolhouse Lane and Main Street in the Town of Hurley, according to the New York State Police.

Troopers from State Police Kingston, members of the Bureau of Criminal Investigation, and the Troop F Collision Reconstruction Unit responded to the crash at about 6:36 p.m. on October 23, State Police said.

The preliminary investigation determined that an unregistered dirt bike, operated by an 18-year-old with a 17-year-old passenger, was traveling westbound on Main Street when the driver attempted to pass a 2015 Hyundai. At the same time, the Hyundai was making a left turn onto Schoolhouse Lane, according to State Police.

The impact ejected both the dirt bike operator and the passenger. Life-saving measures were administered at the scene before both were transported to Kingston HealthAlliance Hospital. The passenger was subsequently pronounced dead. The Hurley Fire Department assisted at the scene.

The incident remains under investigation, and State Police are asking anyone with information to contact State Police Kingston.

This is a developing story. Details may change as the investigation continues.

Key Legal Points After a Fatal Dirt Bike Crash in Hurley, NY

Crashes involving a dirt bike raise questions about fault and insurance that deserve careful review. These points explain how New York law may apply.

  • Who may be liable: the drivers involved and the owners of the vehicles, depending on how the crash happened and what the evidence shows.
  • How fault is decided: investigators examine speed, lane position, signaling, sight lines, and the condition of both vehicles. State Police say their Collision Reconstruction Unit responded.
  • If fault is shared: under CPLR § 1411(b), as amended in 2026, a motor vehicle injury claim is barred when the claimant’s fault equals or exceeds the combined fault of the defendants. Otherwise, damages are reduced by the claimant’s share.
  • Insurance that may apply: State Police describe the dirt bike as unregistered, so which policies respond needs careful review. That can include the Hyundai driver’s coverage and any household, umbrella, or uninsured motorist coverage.
  • What a claim can cover: a wrongful death claim covers funeral and medical expenses and the family’s financial losses, and a separate survival claim covers the passenger’s own pain and suffering before death (EPTL §§ 5-4.1, 11-3.2). The operator’s claim can include medical costs, lost income, and pain and suffering.
  • Deadlines: a wrongful death claim must be filed within two years of the date of death (EPTL § 5-4.1). The date of death was not released, but if it was October 23, 2026, the deadline is October 23, 2028. A personal injury claim for the operator has three years (CPLR § 214), which is October 23, 2029.
  • Government notice: if a road, signal, or intersection condition played a part, a notice of claim against a municipality is generally due within 90 days (General Municipal Law § 50-e), which puts the deadline at January 21, 2027.
