Fatal Motorcycle Accidents in Pennsylvania

When a motorcyclist is killed in Pennsylvania, families need to understand their legal rights and the time-sensitive nature of evidence preservation. Here is what families should know:

Who may be liable:

  • Another driver, if the crash involved a vehicle that failed to yield or was operated negligently
  • A commercial vehicle owner or operator, if a truck or delivery vehicle was involved
  • Government entities, if road defects or inadequate signage contributed to the crash
  • A manufacturer, if a vehicle or motorcycle defect played a role

What attorneys and investigators examine:

  • Skid marks, road surface conditions, and posted speed limits at the crash site
  • Witness statements and any available traffic camera or dashcam footage
  • Police reports, accident reconstruction analysis, and medical records
  • Weather conditions and visibility at the time of the crash

Pennsylvania’s comparative negligence standard:

Pennsylvania follows a modified comparative negligence rule (51 Pa.C.S. § 7102). A wrongful death claim can still proceed even if the motorcyclist was found partially at fault – provided fault does not exceed 50%. An attorney can evaluate the facts before any determination is made.

Your filing deadline:

Wrongful death claims in Pennsylvania must be filed within two years of the date of death (42 Pa.C.S. § 5524). This crash occurred on May 17, 2026 – your deadline is May 17, 2028. Acting early protects critical evidence that may not be retained indefinitely.
