Syracuse, NY (November 4, 2026) – A 40-year-old woman died after being hit by a sedan while riding an electric scooter on the 1500 block of North Salina Street in Syracuse on the night of November 4, according to Syracuse Police. The collision happened around 7:17 p.m.
Officers who arrived found the woman in the roadway after she was struck by the sedan, police said. She was taken by American Medical Response ambulance to Upstate University Hospital, where she was pronounced dead despite lifesaving efforts.
The Syracuse Police Department is actively investigating the circumstances of the collision. Police did not release further details.
This is a developing story. Details may change as the investigation continues.
Legal Points After a Fatal Electric Scooter Crash in New York
- Who may be liable: the sedan driver if the evidence shows a failure to use care, the sedan’s owner under New York’s owner-liability law (Vehicle and Traffic Law 388), and the scooter’s maker or seller if a defect played a part.
- Fault is never assumed: police have not described who was at fault, and a scooter rider’s rights on the road are the same as other road users’ when riding lawfully.
- Shared fault: for motor vehicle claims, New York bars recovery when the claimant’s fault equals or exceeds the combined fault of the defendants (CPLR 1411(b), as amended in 2026). An attorney confirms how that rule applies to a scooter rider.
- Wrongful death and survival claims: her family may seek funeral costs, lost income and support, and the loss of guidance and care. The estate may also seek damages for what she endured before death.
- Deadlines: a wrongful death claim must be filed within two years of the date of death (EPTL 5-4.1), which is November 4, 2028. The survival claim generally has three years (CPLR 214), until November 4, 2029.
- If a road or signal problem is later linked to the crash, a notice of claim to the responsible city, county, or state entity is due within 90 days (General Municipal Law 50-e), which is February 2, 2027.
