One Killed, Six Hurt When Dump Truck

Hopewell, NY (August 19, 2026) – A dump truck and a medical transport bus collided at State Route 488 and Freshour Road in the town of Hopewell, killing one passenger and sending six others to hospitals across Ontario County with injuries ranging from minor to critical, according to Ontario County Sheriff David Cirencione.

Calls reporting the crash came in at 1:49 p.m. The northbound bus, driven by a 75-year-old Phelps man, entered the intersection when it was struck by a 10-wheel dump truck traveling east, operated by a 31-year-old Canandaigua man, the sheriff said.

A 32-year-old female bus passenger was pronounced dead at the scene. Cirencione confirmed the following day that five of the six passengers on board were residents of intermediate care facilities for people with developmental challenges. The woman killed was one of those residents. Her body was taken to Geneva General Hospital for an autopsy. Her identity has not been released.

Four other ICF residents were transported to Strong Memorial Hospital in Rochester, three of them by helicopter. The sheriff said on August 20 that a 27-year-old woman remained under evaluation in the emergency department, while a 41-year-old man was in surgery with what Cirencione described as “significant orthopedic injuries.” A 32-year-old woman was listed in satisfactory condition. A 31-year-old woman had already been released. A 44-year-old male bus employee was taken to Clifton Springs Hospital with minor injuries. The bus driver received treatment at F.F. Thompson Hospital in Canandaigua for minor injuries and was released. The dump truck driver was not injured.

The sheriff described the initial emergency response as massive, saying dispatchers received calls reporting multiple patients with serious injuries and people hanging from the bus windows, which brought a large coordinated deployment of law enforcement, fire, and EMS crews.

The intersection at Route 488 and Freshour Road has a documented record of crashes. A neighbor who lives three houses from the scene told reporters he had counted more than a dozen accidents there in the past year and described the approach as nearly a blind crossing, noting that eastbound trucks traveling at 55 miles per hour are difficult to see until they crest the hill. Sheriff Cirencione acknowledged the challenge directly: “Specifically for northbound vehicles that are gonna cross Route 488, it is a challenge. You have to stop and definitely take an extra second to make sure nobody is coming from either direction.”

Cirencione said the Ontario County District Attorney’s Office will review the findings before determining whether charges are filed. The investigation will likely take several weeks, he said.

This is a developing story. Details may change as the investigation continues.

What to Do After a Fatal Bus Accident in New York

A collision between a commercial dump truck and a medical transport bus carrying vulnerable passengers can involve more than one liable party. Attorneys handling these cases examine several separate angles:

  • The dump truck driver and company: A 10-wheel commercial dump truck is subject to federal and state regulations governing driver qualification, hours of service, maintenance, and cargo. Investigators look at whether the driver held the proper commercial license, whether the company maintained required inspection records, and whether any company policy or equipment failure contributed to the crash.
  • The medical transport operator: A company contracted to carry people with developmental disabilities owes those passengers a heightened duty of care. Its driver qualifications, vehicle inspection history, safety protocols, and dispatch records are all subject to scrutiny in a case like this.
  • The road and intersection: When a public intersection has a documented history of crashes and a known sight-line problem, the authority responsible for the road may share liability. For a state highway such as Route 488, the New York State Department of Transportation is the relevant authority.

Any claim against a state agency such as the Department of Transportation requires a formal Notice of Claim under the Court of Claims Act § 10 within 90 days of the incident. Claims against a county or municipal road authority require notice under General Municipal Law § 50-e, also within 90 days. For an incident on August 19, 2026, that deadline is November 17, 2026. Missing this deadline generally ends a government-entity claim permanently, regardless of the evidence.

New York’s wrongful death statute, EPTL § 5-4.1, gives the estate two years from the date of death to file a civil claim. For a death on August 19, 2026, that deadline is August 19, 2028. Surviving injured passengers have three years from the date of injury under CPLR § 214, placing their personal injury deadline at August 19, 2029. The government notice window closes long before either of those dates.

New York follows a pure comparative fault standard. More than one defendant, including the bus company, the dump truck operator, and the road authority, can each be held partially responsible in the same action.
