West Seneca, NY - Three Hurt After Pickup Truck Flees Police Stop

West Seneca, NY (Sept. 22, 2026) – Three people were hurt, and a pickup truck driver died after a police pursuit ended in a fiery crash on Harlem Road in West Seneca Tuesday night.

According to police, the pickup truck fled a traffic stop around 7:15 p.m. and struck another vehicle traveling north on Harlem Road near the overpass at Indian Church Road. The truck flipped and caught fire; its driver was pronounced dead at the scene. The three people in the other vehicle were taken to Erie County Medical Center with injuries.

This is the second fatal crash tied to a West Seneca police pursuit in three weeks, following the deaths of two teenagers in a stolen vehicle crash on September 3. West Seneca Police, the Erie County Sheriff’s Office, and the New York State Attorney General’s Office are all now involved in reviewing what happened, the Sheriff’s Office assisting specifically for transparency and the Attorney General’s Office conducting its own independent review, as state law requires whenever a death is connected to a police encounter.

A driver who flees from police is choosing to keep driving through an active emergency rather than stop, and everyone else on the road pays the price of that decision if it ends in a crash.

Building a Case After a Police Pursuit Crash

When police say a driver fled from a traffic stop before causing a crash, that account typically comes with radar data, dashcam footage, and officer testimony backing it up, evidence that tends to make fault difficult for an insurance company to contest later. That is different from crashes where the only account of what happened comes from the drivers themselves.

If you were one of the three people in the vehicle that was struck, New York law allows you to pursue compensation for your medical expenses, lost income, and pain and suffering from the driver who caused the crash, a claim that proceeds through his estate and insurance policy since he did not survive.

A vehicle fire like the one in this crash can complicate recovery, even for people who were not badly hurt on impact; smoke inhalation and burns are not always obvious right away. It is worth having a full medical evaluation regardless of how you feel today, and having that evaluation on record if you later decide to pursue a claim.
