A head-on crash on State Route 32 in New Scotland has left one person dead and another in critical condition.
According to the Albany County Sheriff’s Office, deputies responded to the intersection of State Route 32 and Tarrytown Road shortly after 6 p.m. on Saturday, August 22, after reports of a serious crash. Investigators say an Acura traveling south on Route 32 collided head-on with a Subaru traveling north.
The driver of the Subaru, 74-year-old Mark Rose of Westerlo, was pronounced dead at the scene. His passenger, 63-year-old Linda Rose, also of Westerlo, was taken to Albany Medical Center in critical condition. The driver of the Acura, 24-year-old Anthony Depoalo of Schenectady, was not injured. His passenger, 26-year-old Colin Dineen, also of Schenectady, was taken to Albany Medical Center with minor injuries.
The Sheriff’s Office Crash Investigation Team is conducting a crash reconstruction, and the cause of the collision has not yet been determined.
Head-on collisions are among the most severe crashes on the road, often the result of a vehicle drifting or crossing into an oncoming lane. Because both vehicles are typically moving toward each other at highway speed, even a moment of distraction, fatigue, or a mechanical problem can lead to catastrophic injury.
What Are Your Legal Rights After a Serious Two-Car Crash in New York?
A crash like this one raises difficult questions for everyone involved. In head-on collisions, fault typically comes down to which vehicle crossed the center line, and why. That can depend on evidence like skid marks, vehicle data, witness accounts, and road conditions, which is why the ongoing crash reconstruction matters so much here.
If you or someone you love was seriously hurt in this crash, or in a similar collision, and you were not the driver who caused it, New York law may allow you to recover compensation for medical expenses, lost income, and pain and suffering. If a loved one was killed, the personal representative of their estate may also be able to pursue a wrongful death claim on their behalf.
An experienced car accident attorney in Upstate New York can review the police report and the crash reconstruction findings once they are complete, track down witnesses, and work with accident reconstruction experts if needed, so you are not unfairly blamed for a crash that wasn’t your fault.
