Gates, NY – 33-Year-Old Suspect Struck & Killed on I-390

Larceny suspect hit and killed by car on I-390

Gates, NY (November 13, 2025) – A 33-year-old man was struck and killed Thursday afternoon after fleeing officers and running onto Interstate 390 southbound near the Lyell Avenue overpass, according to New York State Police.

The incident began around 12:10 p.m. when Gates Police pursued a larceny suspect who fled from a nearby retail store. During the foot chase, the suspect ran down an embankment and into the southbound lanes of I-390, where he was hit by a passing vehicle.

The pedestrian was pronounced dead at the scene by EMS.

The driver involved, 69-year-old Ronald M. Bandemer of Rochester, remained on site and fully cooperated with law enforcement. He was evaluated at Highland Hospital and later released.

State Police investigators, along with the Collision Reconstruction Unit and the Monroe County Medical Examiner’s Office, responded at the request of Gates Police. Southbound I-390 was closed at Lexington Avenue for several hours while investigators processed the crash scene. The Attorney General’s Office was notified pursuant to state protocol.

The investigation remains ongoing.

Liability in Police-Involved Pedestrian Fatalities

Fatalities that occur during police pursuits involve complex questions of liability. In New York, investigators examine whether officers acted within protocol, whether the fleeing individual created a foreseeable hazard, and whether drivers had the ability to avoid impact. Independent reconstruction and body-worn camera review often play key roles in determining fault.

Families may have rights to seek answers, access reports, or pursue legal action depending on the circumstances. A New York wrongful death attorney can help navigate these matters while ensuring compliance with Attorney General oversight procedures.
