Queens, NY – 68-Year-Old Pedestrian Fatally Struck by Moped Driver

Moped Driver Charged in Fatal Crosswalk Accident

Jamaica, Queens, N.Y. (December 5, 2025) – An elderly male pedestrian was killed in Jamaica, Queens, on Friday evening after being struck in a marked crosswalk by a moped driver who was later arrested and charged.

The fatal crash occurred on 93rd Avenue. Investigators confirmed that the 68-year-old victim was crossing the road in a designated crosswalk when he was hit by a 26-year-old man, identified as Yunior Rodriguez, who was traveling westbound on his moped.

The pedestrian was rushed to Jamaica Hospital but was tragically pronounced dead. The moped driver, Rodriguez, remained at the scene and was transported to Queens Hospital. Police subsequently charged Rodriguez with Aggravated Unlicensed Operation of a Motor Vehicle.

Legal Implications of Unlicensed Operation in a Fatal Crosswalk Accident

This incident involves two critical elements that strongly support a Wrongful Death claim under New York law: the victim was in a marked crosswalk, where he had the right-of-way, and the moped driver was charged with Aggravated Unlicensed Operation (AUO). Under New York traffic law, drivers have an explicit duty to yield to pedestrians in a crosswalk, and the failure to do so is a clear act of negligence.
