Clarkstown, NY (December 18, 2025) – A tragic pedestrian accident claimed the life of an Albany man on the New York State Thruway early Thursday morning.
New York State Police from the Tarrytown Thruway Barracks responded to the scene at approximately 4:40 a.m. on southbound Interstate 87. Investigators determined that Bravo Nondo, 45, of Albany, had stopped his 2020 Nissan on the Exit 14 acceleration ramp. For reasons still under investigation, Nondo exited his vehicle and walked toward the rear of the car while it was still positioned in the acceleration lane.
A second vehicle, a 2019 Nissan operated by Gregg M. Albaum, 35, of Nanuet, was attempting to enter the Thruway using the same ramp. Police report that Albaum took evasive action to avoid striking Nondo’s stopped vehicle but subsequently struck Nondo. Despite life-saving measures performed by emergency responders, Nondo was pronounced deceased at the scene. Albaum was transported to Nyack Hospital for treatment of unspecified injuries.
The New York State Attorney General’s Office has been notified, which is standard procedure in certain fatal incidents, and the investigation remains ongoing. State Police are asking anyone who may have witnessed the crash to contact the Haverstraw Bureau of Criminal Investigation at 845-344-5300.
Understanding Liability in Highway Pedestrian and “Evasive Action” Crashes
This incident on the I-87 Thruway presents a complex legal situation regarding liability and the “Emergency Doctrine” in New York. When a driver stops their vehicle in an active travel lane or acceleration ramp, it creates a significant hazard. Under New York law, the “Emergency Doctrine” may protect a driver who is faced with a sudden and unexpected condition, like a stopped car in a high-speed merging lane, and makes a split-second decision to avoid it. If the driver’s evasive maneuver leads to a collision, they may not be held liable if their actions were deemed reasonable under the circumstances.
