Liability in Multi-Vehicle Pile-Ups in Pennsylvania
This incident highlights the complexities of determining liability in multi-vehicle collisions. In a pile-up involving five vehicles, especially one involving a rollover, determining fault requires a detailed reconstruction of the “first impact” to identify which driver’s negligence initiated the chain reaction. Under Pennsylvania’s modified comparative negligence rule, a victim can recover damages as long as they are not more than 50% at fault for the accident.
