Liability in New York Pedestrian Accidents and Wrongful Death Claims

This fatal incident at a major intersection necessitates a thorough investigation into traffic signals and right-of-way protocols at the time of the impact. Under New York Vehicle and Traffic Law, drivers are required to exercise due care to avoid colliding with any pedestrian and must yield to those within a crosswalk. If the investigation determines that the driver was speeding, distracted, or failed to obey a traffic signal at Merrick Road and Bayview Avenue, the estate of the deceased may have grounds for a wrongful death claim.
