Ithaca, NY – Two Injured in Rollover Crash on West State Street

Two Injured in Rollover Crash

Ithaca, NY (March 10, 2026) — A dramatic rollover accident on West State Street left two people injured on Monday night. The Ithaca Police Department, along with fire and EMS crews, responded to the 500 block of West State Street at approximately 10:00 p.m. following reports of a two-vehicle collision.

Initial reports from the IPD indicate that a traveling vehicle was heading down West State Street when it collided with an occupied, parked car. The force of the impact caused the moving vehicle to lose stability and roll over in the roadway, coming to rest on its roof or side.

Both the driver of the traveling vehicle and the individual sitting inside the parked car were treated at the scene by Bangs Ambulance personnel. Both were subsequently transported to local hospitals for treatment of what police described as non-life-threatening injuries. The 500 block was temporarily closed while the Ithaca Fire Department cleared debris and stabilized the overturned vehicle. The investigation into the cause of the crash—including factors such as speed or distraction—remains active.

Roll-Over Accident in New York

In New York, accidents involving parked vehicles and rollovers trigger a specific set of legal and insurance protocols. As a “No-Fault” insurance state, anyone injured in this collision—whether the driver or the occupant of the parked car—is entitled to Personal Injury Protection (PIP) benefits. These benefits cover up to $50,000 for medical expenses, lost wages, and other “basic economic losses” through their own insurance policy, regardless of who caused the crash.

However, when a vehicle strikes a parked car, liability almost always rests with the moving driver. Under New York Vehicle and Traffic Law (VTL) § 1146, every driver must exercise “due care” to avoid colliding with any person or vehicle on the roadway. Even if a vehicle is parked illegally, New York courts typically find the moving driver primarily at fault because they have a duty to maintain a clear lookout.

For the victims to pursue a lawsuit for “pain and suffering” (non-economic damages), their injuries must meet the “Serious Injury Threshold” defined in New York Insurance Law § 5102(d). This includes fractures, permanent loss of use of a body organ, or a “medically determined injury” that prevents the victim from performing their usual daily activities for 90 of the first 180 days following the accident. In rollover cases, even if initial injuries seem “minor,” the long-term impact of whiplash, concussions, or spinal strain can often meet this legal standard upon further medical evaluation.
