Pedestrian Fatalities and Wrongful Death in New York
Accidents resulting in pedestrian fatalities often involve complex investigations to determine fault and negligence. Under New York law, drivers owe a duty of care to pedestrians, and failure to exercise this duty, such as through distraction or speeding, can lead to severe liability.
For the surviving family members of the deceased, New York law allows for the pursuit of a wrongful death claim if negligence is found to be a contributing factor. A wrongful death claim seeks compensation for various economic and non-economic losses, including funeral costs, medical bills incurred before death, and the loss of financial support and guidance the deceased would have provided.
Early consultation with a qualified New York wrongful death attorney is critical to help preserve evidence and navigate the complex legal and insurance issues that arise following such a severe tragedy.
