Question:  Joe, is it legal for an employer to ask a 60 year old employee how much longer they plan to work?

Joe Knows the Answer:

Certainly asking an employee of 60 years of age fi they are going to retire soon is probably not within the permissible bounds of employer conduct.  Because under our law, you can't terminate an employee because of their age or pay.  These questions they're asking you "how much longer do you intend to work" for example, seem to be directly aimed at that goal.
