Barker, NY - Three Hurt After Kia Rolls in Multi-Vehicle Crash on I-81

Barker, NY (Aug. 30, 2026) – New York State Police and Broome County Sheriff’s deputies responded to multiple crashes on Interstate 81 in the town of Barker, according to police.

State Police at Binghamton responded to the highway near mile marker 25 at about 12:25 p.m. following a crash between two vehicles traveling north, police said.

An investigation found a 2017 Cadillac and a 2012 Kia were both heading north on Interstate 81, with the Cadillac in the right lane and the Kia in the left, according to police. The Cadillac’s driver failed to observe the Kia and moved into the left lane, striking the Kia’s rear quarter panel and bumper.

The Cadillac then struck a guardrail and came to a stop in the right lane, facing the wrong direction. The Kia rolled and came to rest right side up in the median.

The Cadillac’s driver, Joseph Daniel Carhuapoma Rivera, 23, of Fort Drum, was taken to UHS Wilson Medical Center and issued a traffic ticket, police said. A 46-year-old man from Astoria was also taken to UHS Wilson Medical Center following the crash.

The Kia’s driver, Yarema Mikhaylo Duplak, 22, of Ontario, Canada, was also transported to UHS Wilson Medical Center, according to police.

Traffic came to a stop on the highway following the crash, and several drivers tried to get around it by driving the wrong way, police said. Troopers warned that doing so risks a head-on collision and urged drivers to remain patient and follow the direction of law enforcement and emergency personnel.

A crash that flips one car and sends three people to the hospital can turn an ordinary afternoon drive into a painful, disorienting ordeal within seconds.

Car Accidents in Upstate New York

A lane-change crash that ends with one car in the guardrail and another rolled into the median can leave injuries that are not obvious right away, so acting quickly protects both your health and your legal claim.

  • See a doctor the same day, even if you feel fine at the scene
  • Do not give a statement to the other driver’s insurance company before speaking with an attorney
  • Preserve evidence early, including nearby traffic camera footage, the police report, the traffic ticket issued in the crash, and photos of both vehicles and the guardrail damage
  • Do not accept a settlement offer before you understand the full extent of your injuries

New York follows a pure comparative fault rule, so a disputed lane change or speed claim does not automatically prevent a recovery. Under New York law, you generally have three years from the date of the crash to file a personal injury claim under CPLR Section 214, which in this case is Aug. 30, 2029.

An Upstate NY car accident lawyer (stanleylawoffices.com/upstate-ny-car-accident-lawyers/) can help sort out fault between drivers and pursue compensation from the insurance company of the driver who caused the crash.
