Town on Batavia, NY (Sept 13, 2026) – One man is dead and two drivers are recovering after a two-car crash at the intersection of State Route 63 and Batavia-Oakfield Townline Road in the Town of Batavia on Sunday evening.
According to the Genesee County Sheriff’s Office, the crash happened around 6:42 p.m. when a 2020 Jeep Compass traveling west on Batavia-Oakfield Townline Road failed to stop at a stop sign and entered the intersection with Route 63, where it was struck by a 2009 Chrysler Town and Country heading south.
Both drivers were taken to an area hospital with non-life-threatening injuries. The Chrysler’s passenger, Donald Fitch of Basom, was killed in the collision.
Stop sign violations like this one are a leading cause of serious intersection crashes, since a driver who has the right of way on a through road like Route 63 often has little to no warning before a vehicle crosses directly into their path.
Genesee County Car Accident and Wrongful Death Claims
A stop sign is one of the clearest traffic controls on the road, which is part of why a violation like this one tends to leave little room for dispute over fault. When a preliminary investigation already identifies a failed stop as the cause, as it did here, that finding can carry significant weight with insurance companies and, if necessary, in court.
If you were the driver of the Chrysler, an Upstate New York car accident lawyer can help you pursue compensation for your medical expenses, lost income, and pain and suffering from the driver who ran the stop sign.
If you are a family member of Donald Fitch, an Upstate New York wrongful death lawyer can help the representative of his estate bring a claim against the driver responsible. Courts look at the financial impact of losing him, what he contributed to his household, what he would likely have earned and provided in the years ahead, and the practical support his family has lost.
Both types of claims can move forward against the same insurance policy, and an attorney can request the full accident report once finalized and handle communications with the insurer so your family is not left managing that on top of everything else.
