Queensbury, NY (August 29, 2025) – A 45-year-old man, David J. Mitchell of Granville, sustained critical injuries Friday afternoon after being struck by a 2016 Jeep Cherokee at the intersection of Aviation Road and the Exit 19 southbound off-ramp from I-87 in Queensbury, Warren County.
According to preliminary reports from New York State Police, the Jeep, driven by 25-year-old Brodie C. Gerber of Lake George, exited I-87 southbound and turned east onto Aviation Road when it struck Mitchell, who was standing partially in the roadway. Mitchell suffered multiple serious injuries, including broken legs, and was initially transported to Glens Falls Hospital before being transferred to Albany Medical Center.
Witnesses reported seeing Mitchell walking in and out of traffic prior to the crash. EMS personnel confirmed these observations upon arrival.
State troopers conducted field sobriety tests on Gerber, which he failed. He was taken into custody, and a chemical breath test revealed a blood alcohol content of .17%. Gerber was charged with Driving While Intoxicated (DWI) and released on his own recognizance following arraignment. He is scheduled to appear in Queensbury Town Court on September 8, 2025.
The New York State Police Collision Reconstruction Unit responded to process the scene, and the investigation remains ongoing with additional charges possible.
