Our Proven Car Accident Results
Two results from car accident cases we have handled across Upstate New York:
- $300,000 rear-end collision settlement: Won after an insurer argued a compression fracture and disc bulging were minor because our client never had surgery. We built the case around her lost earning capacity instead and settled at mediation.
- $125,000 sideswipe collision settlement: Recovered for a client sideswiped at highway speed by a driver who fell asleep at the wheel. The injury settlement came on top of her separate workers’ compensation settlement for the same crash.
Prior results do not guarantee a similar outcome. Every case is unique, and the value of any claim depends on its specific facts.
What Our Car Accident Clients Say
“Quintessah handled the onboarding with empathy. Naamu Harvey negotiated more from insurance than she expected.”
Everyone in Stanley Law was terrific, from the attorney that did the on-boarding, Quintessah Murdock and her paralegal, Hunter, to the attorney who picked up my case and eventually negotiated the settlement, Naamu Harvey and her paralegal, Adam. Quintessah was extremely empathetic, which was sorely needed after the other driver denied responsibility and my insurance company couldn’t have cared less about me. Then Naamu took over with a huge heart, professionalism, and proved to be an amazing negotiator to get more from the insurance company than I expected. Thank you Naamu. I hope I never need you again, but if I do you will be my first call!!

What to Do After a Car Accident in Batavia, NY
What you do in the minutes and days after a crash can shape your health, your evidence, and eventually your settlement. Take these eight steps:
- Call 911 and request a police response: Ask for the Batavia Police Department or the Genesee County Sheriff’s Office to respond and file an accident report. New York State Police Troop T handles crashes on the Thruway.
- Get evaluated even if you feel fine: The emergency department at United Memorial Medical Center can check for concussions and internal injuries. The nearest adult Level I trauma centers are Strong Memorial Hospital in Rochester and Erie County Medical Center in Buffalo.
- Photograph the scene immediately: Debris gets swept and vehicles get towed within hours. Capture wide shots of both vehicles, close-ups of the damage, and the road surface, skid marks, traffic signs, and weather. If your vehicle has a dashcam, save the footage the same day, because many dashcams record over older clips automatically.
- Get the other driver’s information: Collect their insurance details, plus the names and phone numbers of anyone who saw the crash. Witnesses are far easier to reach the same week than months later.
- File your DMV crash report: Every driver in the crash must file an MV-104 within 10 days if anyone was injured or killed. The same rule applies when one person’s property damage exceeds $1,000 (Vehicle and Traffic Law Section 605).
- Decline a recorded statement to the other driver’s insurer: Its adjusters can call within days, so wait until you have spoken with a lawyer.
- Keep every medical appointment: Gaps in treatment give insurers an easy argument that your injury was not serious.
- File your no-fault application within 30 days: New York requires written notice to your no-fault insurer, usually your own auto insurer, within 30 days of the accident. Late notice can cost you medical and lost-wage benefits unless you can justify the delay.
Most of these steps protect your case whether or not you ever hire a lawyer. The further you get from the crash, the more evidence disappears on its own. Our full guide to what to do after a car accident walks through each step in more detail.

(800) 608-3333Common Causes of Car Accidents in Batavia
Genesee County roads carry local commuters, agricultural traffic, and long-haul trucks, and the combination shapes the most common crash causes around Batavia:
- Distracted driving: texting, GPS use, and in-car screens pull a driver’s eyes off the road and lead to rear-end and intersection crashes.
- Thruway and Main Street traffic: the Thruway runs just north of the city, and Exit 48 feeds trucks onto Route 98 and Main Street. Merges and lane changes in this mix can turn into multi-vehicle crashes.
- Winter weather: ice and heavy snow cut visibility and lengthen stopping distances for months each year. A driver who fails to slow down for conditions can still be found negligent.
- Driving under the influence: alcohol and drugs slow a driver’s reaction time and judgment. An impaired driver who causes a crash can face criminal charges and a civil injury claim.
- Fatigue on long-haul routes: commercial drivers moving freight on the Thruway must follow hours-of-service rules. A carrier’s driver logs can show whether a tired driver broke those rules.
The cause of your accident often decides who is liable and what evidence needs preserving first. It shapes how strong your claim looks once an insurer starts hunting for reasons to pay less.
Who Is Liable for a Car Accident in Batavia?
The driver who caused a Batavia crash is usually liable, but responsibility can extend to other parties depending on how the crash happened:
- Negligent drivers: a driver who was distracted, impaired, or speeding can be held liable for the crash.
- Commercial trucking companies: liability can extend to the carrier itself when driver fatigue, poor maintenance, or an hours-of-service violation causes the crash.
- Rideshare operators and their insurers: coverage for a rideshare crash depends heavily on whether the driver was logged into the app at the time.
- Government entities: a town, county, or state agency can be liable for defective road design, signage, or maintenance. Claims against a government body often require written notice within 90 days.
- Hit-and-run drivers: when an unidentified driver strikes your vehicle and flees, your own uninsured motorist coverage can pay the claim. New York requires physical contact with the fleeing vehicle for this coverage.
Your own share of fault can reduce or even bar your recovery. Our guide to your liability as a driver explains how insurers and juries assign fault.
If the driver who hit you fled or carried no insurance, we can pursue your claim through your own uninsured motorist coverage. Our Upstate New York car accident lawyers look past the police report. The party who caused your crash is not always the one it names.

Compensation You Can Recover After a Batavia Car Accident
After a Batavia car accident, you can recover economic damages for your financial losses and non-economic damages for pain and its effect on your life. Our guide to common injuries in a car accident explains how the severity of harm shapes case value.
Economic Damages
Economic damages are the losses you can prove with a receipt, a pay stub, or a medical bill. No-fault insurance pays up to $50,000 for medical bills, most lost wages, and some other costs, regardless of fault, with limited exceptions. It does not cover vehicle damage, which you can claim from the at-fault driver along with losses above that amount:
- Medical expenses: emergency care, surgery, physical therapy, and any future treatment your injury requires.
- Lost wages: income lost while you recover, plus reduced earning capacity if your injury affects your ability to work long term. No-fault pays 80 percent of lost earnings, up to $2,000 a month, for up to three years.
- Property damage: repair or replacement costs for your vehicle and anything damaged in the crash.
Non-Economic Damages
Non-economic damages pay for losses that come with no receipt, such as pain, distress, and lost enjoyment of life:
- Pain and suffering: compensation for the physical pain and discomfort caused by your injury.
- Emotional distress: anxiety, sleep disruption, or lingering fear of driving after a serious crash.
- Loss of enjoyment of life: the hobbies, activities, and routines your injury has taken away, sometimes permanently.
For lawsuits filed on or after May 26, 2026, New York caps non-economic damages at $100,000 for some injured drivers who were at fault. The cap, set by Insurance Law Section 5104(d), covers a driver convicted of impaired driving, or of a felony committed while driving. It covers a driver of an uninsured vehicle they were required to insure, unless the coverage lapse lasted under 30 days.
The cap reaches only non-economic damages. It does not limit medical bills, lost wages, or claims for a death.

New York Car Accident Laws That Affect Your Batavia Claim
New York rewrote its car accident injury laws effective May 26, 2026, for lawsuits filed on or after that date. The changes affect two questions that decide most cases: whether your injury qualifies to sue, and how shared fault affects what you recover. Read our full breakdown of New York’s 2026 car accident law changes for the complete list of what changed.
How Does Shared Fault Affect My Recovery?
In injury lawsuits filed on or after May 26, 2026, a jury compares your fault with the combined fault of everyone you are suing. If your share is greater, you recover nothing. If it is not greater, your damages are reduced by your percentage of fault. Lawsuits filed before that date follow New York’s older pure comparative negligence rule, which allows some recovery at any fault level.
Which Injuries Meet New York’s Serious Injury Threshold?
Qualifying injuries include fracture, significant disfigurement, dismemberment, and permanent consequential limitation of use of a body organ or member. The last category means a permanent injury that significantly limits how a body part works. New York’s no-fault insurance system blocks pain-and-suffering claims for injuries below the threshold. Effective May 26, 2026, the 90/180-day category, for injuries that kept you from daily activities for 90 of the first 180 days, no longer qualifies.
How Long Do I Have to File a Car Accident Lawsuit in New York?
You generally have three years from the date of the accident to file a personal injury lawsuit in New York. A wrongful death claim must be filed within two years of the death. Claims against a city, county, or school district need a notice of claim within 90 days and a lawsuit within one year and 90 days.
If any of these changes sound like they could affect your claim, reach out to us at 1-800-608-3333 now for a free case review. We will tell you plainly where you stand before you decide anything.

(800) 608-3333Frequently Asked Questions About Batavia Car Accident Claims
What Should I Do If the Other Driver Fled the Scene of My Batavia Car Accident?
If the other driver fled the scene, report the crash to police within 24 hours and notify your own insurer. Your uninsured motorist coverage can pay the claim when the fleeing vehicle made physical contact with yours. If no policy applies, the Motor Vehicle Accident Indemnification Corporation may cover you.
How Do I Get a Copy of My Batavia Car Accident Report?
You can order a copy of your Batavia car accident report from the New York DMV online or through its Records Request Navigator. Mail requests use Form MV-198C. Online orders cost a $7 search fee plus a $15 report fee per report.
What Insurance Must Batavia Drivers Carry Under New York Law?
Batavia drivers must carry at least $25,000 in bodily injury coverage per person, $50,000 per accident, and $10,000 for property damage. Every policy must include $50,000 in no-fault coverage. Uninsured motorist coverage is required at the same $25,000 and $50,000 bodily injury minimums.
How Is Fault Divided When Multiple Vehicles Are Involved in a Batavia Crash?
Fault in a multi-vehicle Batavia crash is divided by percentage, such as 70/20/10 across three drivers. Under New York’s 2026 reform, the jury decides fault before deciding whether any injury meets the serious injury threshold. Your share of fault is then compared with the combined fault of everyone you sue.
Will My Case Still Be Worth Pursuing If I Was Partly at Fault?
Yes, a case can be worth pursuing if you were partly at fault. In lawsuits filed since May 26, 2026, recovery is barred only when a jury finds you more at fault than everyone you sue combined. Below that line, your award is reduced by your percentage of fault.
How Much Does It Cost to Hire a Batavia Car Accident Lawyer?
Hiring a Batavia car accident lawyer at our firm costs nothing upfront. Our contingency fee is about one-third of your recovery, collected only if we win. We advance all case costs and are reimbursed from the recovery. Learn more about how car accident lawyers charge.
What Happens After I Hire Stanley Law Offices for My Car Accident Claim?
After you hire Stanley Law Offices for your car accident claim, we investigate the crash, collect your medical records, and handle insurance communications for you. We negotiate with the insurer and file a lawsuit when negotiation stalls. Our car accident lawsuit process guide explains each step.
Will I Have to Go to Court for My Batavia Car Accident Claim?
No, not always. A car accident claim can settle through negotiation or mediation before trial, as our $300,000 rear-end case did. If a lawsuit is filed, it is usually heard in Genesee County Supreme Court at 1 West Main Street. Our team handles the filings for you.
What Questions Should I Ask Before Hiring a Car Accident Lawyer in Batavia?
Before hiring a car accident lawyer in Batavia, ask three questions. Who will handle my file day to day? How is the fee calculated? Has the firm taken car accident cases to trial? Our list of questions to ask a lawyer after a car accident covers more to raise.
Do I Really Need a Lawyer for a Minor Car Accident in Batavia?
No, not every minor car accident in Batavia needs a lawyer. No-fault insurance pays most medical bills and lost wages regardless of fault. A lawyer helps when injuries worsen, fault is disputed, or an injury may meet the serious injury threshold. Our minor car accident guide explains when.
What If the Insurance Company Offers a Quick Settlement After My Batavia Crash?
If the insurance company offers a quick settlement after your Batavia crash, do not accept it before speaking with a lawyer. Early offers usually arrive before treatment ends and lost wages are known. Signing a release usually ends your claim against everyone it names and can affect other coverage.
How Long Does a Batavia Car Accident Claim Take to Settle?
A Batavia car accident claim generally takes one to three years to settle. Clear liability and completed treatment shorten the timeline. Disputed fault, serious injuries, or a lawsuit extend it. A free case review gives a realistic estimate based on the specific facts of your crash.
