Philadelphia, PA – Infant Killed, Mother Critical in DUI Ambulance Crash in Frankford

Philadelphia, PA (March 15, 2026) — A horrific Sunday morning collision in the Frankford section of Philadelphia has claimed the life of a one-month-old girl and left her mother in critical condition. The crash involved a private ambulance whose driver was subsequently arrested on suspicion of driving under the influence.

Philadelphia Police report that the incident occurred at approximately 5:15 a.m. at the intersection of Torresdale and Harbison Avenues. A private ambulance, operated by Medstar EMS, was traveling southbound on Torresdale Avenue at a high rate of speed. Investigators determined that the ambulance was not operating with its emergency lights or sirens activated.

The ambulance allegedly proceeded through a steady red light at the intersection, broadsiding a 2010 Honda Accord that was traveling through a green light. The force of the T-bone impact was so violent that it ejected both a one-month-old infant and her mother through the Honda’s windshield.

The child, identified by police as Marian Harris, was pronounced dead at a nearby hospital at 6:17 a.m. Her mother sustained severe head injuries and remains in critical condition. The driver of the ambulance was taken into custody at the scene for suspected DUI; an investigation into the crash remains ongoing by the PPD Accident Investigation Division.

Car Accident in Pennsylvania

This tragedy involves some of the most egregious violations of Pennsylvania traffic and criminal law. When an individual operates a vehicle while intoxicated and causes a fatality, they face charges of Homicide by Vehicle While DUI (75 Pa. C.S. § 3735). In the Commonwealth, this is a second-degree felony that carries a mandatory minimum prison sentence for each death caused.

Beyond the criminal aspect, the civil liability in this case is significant. While Pennsylvania’s “Choice No-Fault” insurance system generally limits the ability to sue for non-economic damages (pain and suffering), those limitations are waived in cases of “serious injury” or death. The severe head trauma suffered by the mother and the loss of infant Marian Harris undeniably meet the Serious Injury Threshold, allowing the family to pursue a full range of damages.

Furthermore, the involvement of a private EMS company introduces the concept of Vicarious Liability. Under this legal doctrine, an employer like Medstar EMS can be held responsible for the negligent—and in this case, potentially criminal—acts of their employees committed within the scope of their employment. A Pennsylvania auto accident lawyer would also investigate Negligent Hiring or Negligent Retention claims to determine if the company failed to properly vet the driver’s history of alcohol or drug use.
