Car Accident Rights for Children and Families in Pennsylvania
When a child is hit by a vehicle, families face not only the trauma of their child’s injuries but also the challenge of navigating Pennsylvania’s legal system. Under Pennsylvania’s modified comparative negligence standard, you can recover compensation as long as you’re found to be 50 percent or less at fault. In cases involving young children, the law recognizes that a toddler or small child cannot be held responsible; fault typically rests with the driver. Your family may be entitled to compensation for medical bills, ongoing treatment, long-term care needs, pain and suffering, and other damages related to the crash.
Pennsylvania gives families two years from the accident date to file a personal injury claim, though this timeline can be extended when the victim is a minor. However, critical evidence disappears fast—surveillance footage gets deleted, accident scene conditions change, and witnesses forget details. Consulting a qualified car accident attorney in northern PA right away helps preserve the evidence you need and protects your child’s right to full compensation while you focus on their recovery.
