Car Accident Liability Under New York Traffic Law

Car crashes in New York often raise complex questions about who had the right of way and whether either driver failed to observe traffic controls or yield appropriately. Under New York’s pure comparative negligence rule, injured parties may recover compensation even if they are found partially at fault, though their award is reduced in proportion to their share of responsibility. This means that even if a victim bears some degree of fault, they are not barred from seeking damages for medical expenses, lost wages, and pain and suffering.

New York’s No-Fault system requires injured motorists to first access their own Personal Injury Protection coverage for medical costs and lost wages up to $50,000. To pursue additional compensation for pain and suffering, a victim must meet the serious injury threshold defined under New York Insurance Law Section 5102(d). With four people hospitalized following this crash, several individuals may have grounds to explore all available legal options. Consulting an experienced Upstate New York car accident attorney as early as possible can help preserve key evidence, including vehicle data, surveillance footage, and witness accounts, before they are lost.
