Question:  My mother passed away 18 years ago and my father's had a companion for the past 13 years. He recently put her name on his house in Florida. When he dies, are my brother going to have a difficult time claiming any rights to this property?

Answer: Yes you're definitely going to have a very hard time because he's free to put the property in her name.  She'll own at least half or all of the property upon his death and you'll have a considerable difficulty.  Unless he changes the deed to include your name(s) there's nothing you can do about it.  I recommend discussing the issue with your father so he's able to share his thoughts on it and vice versa.
