Nilsa Cruz (66) Killed in West Brighton Pedestrian Crash

Staten Island, NY (December 18, 2025) – A tragic pedestrian accident in West Brighton claimed the life of a 66-year-old woman and left two others injured on Thursday evening. The NYPD has identified the deceased as Nilsa Cruz, a resident of the Mariners Harbor Houses.

The collision occurred at approximately 5:50 p.m. on Castleton Avenue, roughly 46 feet west of the Barker Street intersection. According to police sources, Cruz was crossing the street alongside two other women, ages 51 and 29, in an area without a traffic light or marked crosswalk. A westbound 2019 gray Ford F-250 struck all three women. While the survivors sustained stable injuries—including head and back pain—Cruz initially reported stomach pain before succumbing to severe internal injuries at Richmond University Medical Center. The driver of the pickup truck remained at the scene and cooperated with investigators. As of Friday afternoon, no criminal charges have been filed, though the investigation by the NYPD Highway District’s Collision Investigation Squad remains active.

Liability and Comparative Negligence in New York Pedestrian Accidents

This devastating incident highlights the critical legal nuances surrounding pedestrian safety and driver responsibility in New York City. While preliminary reports indicate the victims were crossing outside of a marked crosswalk, New York’s pure comparative negligence standard ensures that pedestrians may still be entitled to compensation even if they are found partially at fault. Under New York Vehicle and Traffic Law, drivers maintain a continuous duty to exercise “due care” to avoid colliding with any pedestrian upon any roadway. They must provide a warning by sounding a horn when necessary.
