Syracuse, NY – Crash Involving Syracuse Police Car on Erie Boulevard East Injures Another Driver

Crash Involving Syracuse Police Car

Syracuse, NY (August 14, 2026) – A driver was taken to St. Joseph’s Hospital after a crash involving a Syracuse Police Department patrol car at the intersection of Erie Boulevard East and North Townsend Street, according to Syracuse Police Department Spokesperson Sergeant Thomas Blake.

The crash occurred at approximately 10:07 a.m. The patrol car’s lights and sirens were not activated at the time of the crash, and the officers were on a routine patrol rather than responding to an emergency, Sgt. Blake said. The two officers were transported to Upstate University Hospital and listed in stable condition. The driver of the black Hyundai Elantra that collided with the patrol car was also listed in stable condition at St. Joseph’s. Both Erie Boulevard East and North Townsend Street were closed for a period following the crash before reopening.

Anyone who witnessed the crash or has information is asked to contact the Syracuse Police Department Traffic Division at (315) 442-5130. The investigation is ongoing.

This is a developing story. Details may change as the investigation continues.

Crashes Involving Government Vehicles in Syracuse, New York

A crash involving a City of Syracuse patrol car triggers a different legal process than a crash with a private driver. If the police vehicle’s operation contributed to the crash, the injured driver’s claim is against the city, and that changes the timeline significantly.

  • Notice of Claim requirement: Before any lawsuit can be filed against a New York city, county, or municipality, the injured person must serve a formal Notice of Claim on the government entity. Under General Municipal Law § 50-e, that notice must be filed within 90 days of the incident. For a crash on August 14, 2026, the Notice of Claim deadline is November 12, 2026. Missing this deadline typically bars the claim permanently, regardless of how clear the evidence is.
  • What the Notice of Claim covers: The Notice puts the city on formal notice of the claim, identifies the injured party, describes the nature of the injury and how it occurred, and states where the claimant can be examined. An attorney prepares this document. It is not something to draft without one.
  • No lights or sirens changes the analysis: Because the patrol car was on routine patrol and its lights and sirens were not activated, it was not operating under New York’s emergency vehicle exception, which permits officers to proceed through red lights or disregard certain traffic rules during emergency responses. Without that exception, the patrol car was bound by the same traffic laws as any other driver. If the officer’s actions contributed to the crash under standard traffic rules, the City of Syracuse can be held responsible without the city claiming emergency privilege as a shield. Fault has not been established and the investigation is ongoing, but this distinction is legally significant and favors the other driver’s potential claim.
  • Personal injury claim timeline: Once the Notice of Claim is properly served, the injured driver has one year and 90 days from the date of the incident to file a lawsuit against the city (General Municipal Law § 50-i). The three-year standard statute of limitations that applies to private-party crashes does not apply when the defendant is a government entity. Acting within the 90-day notice window is the critical first step.

Even if the investigation eventually finds that the police officer was not at fault, consulting an attorney now costs nothing and protects the option to pursue a claim later if the facts develop differently.

A driver taken to the hospital after a crash with a city vehicle has a 90-day window from August 14 to preserve the right to bring a claim against the City of Syracuse. That deadline does not pause while the police investigation runs. It does not extend because the facts are still being gathered. It runs from the date of the crash and stops at 90 days.

Our Syracuse car accident lawyers handle claims involving government vehicles regularly and know how to prepare and file a proper Notice of Claim on time, how to preserve the police report and any available intersection camera footage from Erie Boulevard East, and how to build a case that does not rely on the city to investigate itself fairly.
