It is unknown whether New York will actually adopt any of these laws, but there is at least a precedent for a BAC restriction of just 0.05%. Four years ago, Utah became the first state to implement this law, and many called it the “strictest DUI law in the nation.” Aimed at deterring not only seriously intoxicated individuals but also “social drinkers,” many have celebrated Utah’s tough approach, arguing that other states should follow suit (2).
